1. Acceptance of Terms

By accessing or using this website, you agree to these Terms of Service as they relate to your use of the website.

When you book or receive services from Physio by Design, additional clinic policies, consent requirements, payment arrangements, and applicable laws may also apply.

If you do not agree with these terms, please do not use this website.

2. Use of This Website

This website provides general information about Physio by Design, our services, and educational resources.

Content on this website, including the Educational Hub and Client Lounge, is general in nature unless expressly stated otherwise. It is intended to support education and understanding and does not replace individual clinical assessment, diagnosis, treatment, or medical advice.

Information on this website should not be relied upon as a substitute for advice from an appropriately qualified health professional who is familiar with your individual circumstances.

We aim to keep this website accurate and available but do not guarantee that it will always be uninterrupted, error-free, or completely current.

The website may contain links to or rely on third-party websites, booking systems, payment services, health-fund claiming systems, or other external services. Physio by Design does not control those third-party services and is not responsible for their availability, content, or operation except to the extent required by law.

3. Appointments & Cancellations

  • Appointments may be booked online, by phone, or in person.
  • We request at least 24 hours' notice if you need to cancel or reschedule an appointment.
  • Late cancellations or missed appointments may incur a cancellation fee in accordance with our current cancellation policy.
  • Where an appointment is funded or managed by a third party, additional cancellation requirements may apply.
  • We may need to reschedule an appointment because of clinician illness, emergencies, or other unforeseen circumstances. Where this occurs, we will make reasonable efforts to contact you and arrange an alternative appointment.

4. Payments & Health Fund Claims

Payment is due at the time services are provided unless another arrangement has been agreed in advance.

HICAPS claiming may be available for eligible private health fund services. Rebates and out-of-pocket costs depend on your insurer, policy, level of cover, and the service provided. You are responsible for confirming your eligibility and expected rebate with your health fund.

Medicare, DVA, WorkCover Queensland, CTP insurers, NDIS arrangements, and other third-party funding or claiming pathways are subject to their respective eligibility, referral, approval, documentation, and billing requirements.

Where a third party does not approve or pay a claim, you may remain responsible for fees where permitted by the relevant funding arrangement and applicable law.

5. Clinical Advice Disclaimer

General information, exercises, movement strategies, and educational resources provided through this website, the Educational Hub, or Client Lounge are intended to support individualised care rather than replace it.

Exercises or strategies may not be appropriate for every person, injury, condition, or stage of recovery.

Follow the individual advice provided by your treating clinician where it differs from general website information.

If your symptoms are severe, worsening, unusual, or concerning, seek appropriate clinical or medical assessment. In a medical emergency, seek emergency medical assistance.

6. Intellectual Property

Unless otherwise indicated, content on this website — including text, graphics, logos, educational materials, photographs, videos, frameworks, and other resources — is owned by Physio by Design or used under licence and is protected by applicable intellectual property laws.

You may access website content for your personal, non-commercial use.

You must not reproduce, modify, distribute, republish, sell, commercially exploit, or create derivative materials from protected content without prior written permission from Physio by Design or the relevant rights holder, except where permitted by law.

7. Limitation of Liability and Privacy

To the maximum extent permitted by law, Physio by Design excludes liability for indirect or consequential loss arising solely from use of, or reliance on, general information provided through this website.

Nothing in these Terms excludes, restricts, or modifies any right, remedy, consumer guarantee, warranty, or other protection that cannot lawfully be excluded or limited, including rights available under the Australian Consumer Law.

These Terms do not limit any legal obligations applying to the provision of healthcare services by Physio by Design or its practitioners.

Personal and health information may be collected when you contact us, book an appointment, complete forms, access relevant client resources, or receive services.

How this information is collected, used, stored, and disclosed is addressed in our Privacy Policy and applicable privacy and health-records legislation.

8. Governing Law

These Terms are governed by the laws applying in Queensland, Australia.

You submit to the jurisdiction of the courts and tribunals with jurisdiction in Queensland, subject to any rights you may have under applicable Australian law.

9. Changes to These Terms

We may update these Terms from time to time.

The current version will be published on this website together with its effective or last-updated date.

Your continued use of the website after an update means that the revised Terms apply to your subsequent use of the website.
